To qualify for a green card as a priority worker in the Extraordinary Ability, or EB-1A, classification, the applicant must prove extraordinary ability in the sciences, arts, education, business, or athletics. Through reliable and extensive documentation, the applicant must show that they have been publicly recognized for their achievements, while demonstrating a period of sustained national or international acclaim. This classification has several advantages:

 

(1) it does not require that the applicant has a job offer;
(2) applicants don’t have to demonstrate that they have an employer in the U.S.;
(3) applicants may file for immigration petition on behalf of themselves.

 

Although there is a tremendously high standard to qualify, for those who do qualify as individuals of extraordinary ability, immigration procedures can be somewhat simplified. To have the EB-1A petition approved, the foreign national will need to show evidence of a once in a lifetime award of great significance, like a Pulitzer Prize, Olympic medal or similar achievement; or show evidence of at least three of the following:

  • Receipt of lesser nationally or internationally recognized prizes or awards for excellence
  • Membership in associations in the field, which demand outstanding achievement of their members
  • Published material about you in professional or major trade publications or other major media
  • Being asked to judge the work of others, either individually or on a panel
  • Original scientific, scholarly, artistic, athletic, or business-related contributions of major significance to the field
  • Authorship of scholarly articles in professional or major trade publications or other major media
  • Work that has been displayed at artistic exhibitions or showcases
  • Performance of a leading or critical role in distinguished organizations
  • Commanding a high salary or other significantly high remuneration in relation to others in the field
  • Commercial successes in the performing arts
